A-22 of indian constitution talks about punitive Detention.
it explicitly had provisions on preventive Detention.
preventive detention to detain a person as a precautionary measure to prevent him from committing and offence.
according to A22:
the maximum period a person can be detained without obtaining opinion of advisory board is 3 months.
it was reduced to 2 months by 44th constitutional amendment act 1978
this particular provision yet had not brought into force.
and therefore the original provisions of 3 months is still in force.
